Conseil ElementShift Inc., doing business as ElementShift ("ElementShift", "we", "us", or "our"), is a business incorporated and based in Montreal, Quebec, Canada, and is the controller of personal information collected through the Site and through outreach to prospective and existing business contacts. This Privacy Policy explains how we collect, use, store, and protect personal information when you visit our website at https://www.elementshift.com (the "Site"), submit a form on the Site, or otherwise communicate with us by SMS, email, or phone.
This Policy is intended to comply with Canadian privacy laws including the federal Personal Information Protection and Electronic Documents Act (PIPEDA) and Quebec's Act respecting the protection of personal information in the private sector (Law 25), as well as applicable U.S. state privacy laws and mobile carrier requirements for A2P 10DLC messaging.

1. Information we collect
We only collect information that is reasonably necessary for the purposes described in this Policy. Specifically, we collect:
Information you provide directly to us:
Your name, business name, role, and work contact details (email address, phone number) when you fill out a form on our Site, request information, or otherwise communicate with us.
Any other information you choose to share in messages, calls, meetings, or follow-up correspondence.
Information collected automatically when you visit the Site:
Basic technical information such as IP address, browser type, device type, referring URL, pages viewed, and time spent on pages.
Information collected via cookies and similar technologies to operate the Site and understand how it is used.
Information from publicly available business sources:
For business-to-business outreach, we may obtain professional contact information (e.g. work email, work phone, job title, company name) from publicly available sources such as company websites, LinkedIn, business directories, or B2B data providers, in accordance with applicable law.
We do not knowingly collect personal information from individuals under the age of 18. The Site and our services are directed to businesses, not consumers or children.
2. How we use your information
We use personal information for the following purposes only:
To respond to your inquiries and requests.
To send you transactional messages by SMS, email, or phone in connection with our communications with you — for example, replies to questions, follow-ups on conversations you have initiated, meeting confirmations, scheduling, and account or project-related updates.
To conduct business-to-business outreach where permitted by law (for example, contacting a business contact at their work email or work phone about services that may be relevant to their organization).
To operate, maintain, secure, and improve the Site.
To comply with our legal obligations and protect our legal rights.
We do not use your information for any purpose that is incompatible with the purpose for which it was collected, without first obtaining your consent.
3. SMS messaging — opt-in, frequency, and opt-out
When you provide your phone number through our Site and check the SMS consent box, you expressly agree to receive text messages from ElementShift in response to your inquiry, including follow-ups related to forms you submit or missed calls.
Message frequency varies based on your interactions with us. You will not receive a fixed number of messages per day or per week.
Message and data rates may apply, depending on your wireless plan and carrier.
Reply STOP at any time to any SMS message we send you to unsubscribe. After replying STOP, you will receive a confirmation message and will not receive further SMS messages from that ElementShift phone number unless you opt in again.
Reply HELP at any time to receive contact information for support, or contact us directly at noam@elementshift.com.
Carriers are not liable for delayed or undelivered messages.
Your consent to receive SMS messages from ElementShift is never sold, rented, shared, or transferred to any third party or affiliate for any purpose. See Section 6 below.
4. How we store and protect your information
We store personal information on secure cloud-based platforms operated by reputable service providers, with access limited to authorized personnel on a need-to-know basis. We use commercially reasonable administrative, technical, and physical safeguards designed to protect personal information against loss, theft, and unauthorized access, disclosure, copying, use, or modification.
We retain personal information only for as long as is reasonably necessary to fulfill the purposes for which it was collected, including for legitimate business follow-up, to comply with applicable legal and regulatory obligations, and to enforce our agreements. When personal information is no longer needed, we securely delete or anonymize it.
No method of transmission or storage is 100% secure. In the event of a confidentiality incident involving your personal information, we will notify you and the relevant regulator if required by applicable law (including Quebec's Law 25).
5. Sharing of personal information — what we do NOT do
We do not sell, rent, lease, trade, or otherwise share your personal information — including phone numbers, email addresses, and SMS opt-in information — with third parties or affiliates for their own marketing, promotional, or any other purposes.
Mobile information, including phone numbers and SMS consent, is not shared with third parties or affiliates for marketing or promotional purposes. This restriction applies to all the categories of personal information described in this Policy.
The only limited situations in which we may share personal information are:
Service providers acting on our behalf. We use a small number of trusted vendors who help us operate our business — for example, our CRM and communications platform (Close, which uses Twilio for SMS delivery), our email infrastructure provider, our website host, and our analytics provider. These service providers only process personal information as necessary to deliver services to us, under contractual confidentiality and data-protection obligations, and are not permitted to use the information for their own purposes.
Business transfer. If ElementShift is involved in a merger, acquisition, reorganization, or sale of assets, personal information may be transferred to the successor entity, subject to the same protections described in this Policy.
Legal compliance. We may disclose personal information when required to do so by law, court order, or other valid legal process, or to protect our rights, safety, or property, or the rights, safety, or property of others.
With your consent. We may share personal information for other purposes if you give us your explicit consent to do so.
We do not transfer personal information outside of Canada except to the limited service providers described above. Some of these providers (such as Twilio and Close) are located in the United States and may process personal information there, subject to appropriate contractual safeguards. By using the Site or communicating with us, you consent to this limited transfer.
6. Cookies and analytics
The Site uses a limited number of cookies and similar technologies to operate properly and to help us understand how the Site is used. You can configure your browser to refuse cookies; however, some features of the Site may not function properly without them.
7. Your rights
Subject to applicable law, you have the right to:
Access the personal information we hold about you.
Correct inaccurate or incomplete personal information.
Withdraw your consent to our processing of your personal information, including by replying STOP to opt out of SMS, unsubscribing from emails, or asking us to stop calling you.
Request deletion of your personal information, subject to our legal and contractual retention obligations.
Request portability of your personal information in a structured, commonly used format (where applicable under Quebec Law 25 or other applicable law).
File a complaint with us or with the relevant regulator — in Quebec, the Commission d'accès à l'information (CAI); in the rest of Canada, the Office of the Privacy Commissioner of Canada (OPC).

8. Links to other websites
The Site may contain links to third-party websites. We are not responsible for the privacy practices of those websites. We encourage you to read their privacy policies before submitting personal information to them.
9. Changes to this Policy
We may update this Privacy Policy from time to time to reflect changes to our practices or to applicable law. When we do, we will update the "Last updated" date at the top of this Policy and, where appropriate, provide additional notice. We encourage you to review this Policy periodically.
